  • Repayment:
    Chapter 13 is a debt repayment and reorganization. The 3-5 year repayment period allows people to catch up on debts and stay in their homes.
  • Strip the second mortgage or junior liens:
    When there is no longer enough value in the house to secure both mortgages or because the first mortgage has first claim to the home’s equity, a second or third mortgage is then unsecured and can then be discharged through bankruptcy, like credit card and medical expense debts.
  • Automatic stay:
    Once your case is filed, whether you file a Chapter 7 or Chapter 13 bankruptcy, collectors are legally forbidden to continue collections activities against you. This allows time for repayment, so you can keep your home.
  • Negotiation:
    In our current economy, many lenders are more willing to work with debtors than they used to be. While our office does not negotiate loan modifications, bankruptcy can stall a foreclosure process in order to give you, or your agent, time to negotiate loan modification options.
